Appeals

Sometimes, for various reasons applications don't work out as planned. That does not mean the end of the project.

When should you appeal?

Our planning team has a vast amount of experience in planning appeals having been at the forefront of the process for the past 20 years. If it is one of our own projects; we would advocate an appeal as we only submit applications we feel can be successful. If however, you have a project that has been refused we can assess the reason of refusal. Sometimes it is an appeal process or requires a new approach that we can assist with.

As a Chartered Royal Town Planning Institute Practice, we undertake all forms of appeals including written submission, Informal Hearings and Public Enquiries.  Our team is also used by Councils for defence of Public Enquiries when complex matters arise.

Look for an alternative plan.

The majority of appeals we undertake have been recommended planning permission by the Planning Officer, but this recommendation has been overturned by a Planning Committee made up of Local Councillors. Sometimes, they are simply rejected unjustly.

Appeals are an important part of the planning system, it keeps decision making honest and transparent with an independent body acting as an impartial decision maker. This third party is the Planning Inspectorate based in Bristol.

As well as planning appeals, we undertake complex Enforcement Appeals where enforcement notices have been issued. Such appeals are of time importance for submission of the appeal and are often serious, due to potential demolition works being sought by Councils.

We have worked on many enforcement appeals defending the position and finding compromise to safeguard what has been built without planning permission.

Bottom line - we may be able to help, so get in touch.
